Carne v Crime and Corruption Commission [2022] QCA 141

A public official was investigated by the crime and corruption commission, ultimately the finding was that there was neither serious crime nor corruption. The public official resigned prior to the conclusion of the investigation. The crime and corruption commissioned sought to Publish the report by seeking a direction for the publication of the report by the Parliamentary Crime and Corruption Committee. The public official lawyered up and resisted the publication of the report.

The majority of the court reviewed the statute and purposes of the act. The majority ultimately found the report was not a kind to which section 69(1)(b) applied because it is not a report made by the commission in the performance of any of its statutory functions under s 64(1).
